2. Overview
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and German data protection law. Below we explain what we process when you visit this website, place an order, contact us, or subscribe to our newsletter.
3. Hosting and shop platform (Shopify)
Our website and online shop run on Shopify.Provider: Shopify International Limited, 2nd Floor Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland. When you visit the site, Shopify processes technical access data on our behalf (IP address, date and time, browser type, referrer URL, pages viewed) to deliver the website securely and reliably. Legal basis: Art. 6 (1) (f) GDPR (legitimate interest in a secure, functional website). Shopify may transfer data to Canada (EU adequacy decision) and to the United States; such transfers are safeguarded by the EU-US Data Privacy Framework and/or EU Standard Contractual Clauses. We have concluded a data processing agreement with Shopify.
4. Cookies and consent
We use cookies and similar technologies. Strictly necessary cookies (e.g. shopping cart, login, region and language, storing your cookie preferences) are used on the basis of § 25 (2) TDDDG and Art. 6 (1) (f) GDPR. All other cookies and tracking technologies (statistics, marketing) are used only with your consent given via our cookie banner (§ 25 (1) TDDDG, Art. 6 (1) (a) GDPR). You can
withdraw or adjust your consent at any time with effect for the future via the cookie settings link on this website.
5. Orders and contract processing
When you place an order, we process the data required to perform the contract: name, delivery and billing address, email, phone number (if provided), order details and payment data. Legal basis: Art. 6 (1) (b) GDPR. We share data only as necessary with: payment service providers (Shop Pay, PayPal, Apple Pay, Google Pay, Visa, MasterCard, American Express, Union Pay), shipping companies (Nova Poshta, Nova Post, and Deutsche Post DHL services (Warenpost, DHL Paket) for delivery, and our tax advisor where legally required. We retain contract and billing data for the statutory German commercial and tax retention periods (up to ten years, §§ 147 AO, 257 HGB) and delete or restrict it afterwards.
6. Customer account
If you create a customer account, we process your account data to provide the account (Art. 6 (1) (b) GDPR). You can delete your account at any time by contacting us.
7. Newsletter
You can subscribe to our newsletter with your email address. We use a double opt-in procedure: you receive a confirmation email and are subscribed only after clicking the confirmation link. Legal basis: your consent, Art. 6 (1) (a) GDPR. We log the subscription and confirmation to be able to prove consent (Art. 6 (1) (f) GDPR). You can unsubscribe at any time via the link in every newsletter or by emailing info@temptress.me. Newsletter service provider: Mailchimp, acting as our processor.
8. Contact
If you contact us by email, we process your message and contact details to handle your request (Art. 6 (1) (b) or (f) GDPR). We
delete correspondence when it is no longer required, unless statutory retention periods apply.
10. Social media
We maintain an Instagram profile (@temptressmagazine). When you visit our profile, Meta processes your data under its own responsibility: please see Meta's privacy policy. Where Instagram content is embedded on our website, it loads only after your consent via the cookie banner.
9. Analytics
Google Analytics 4 (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland): usage statistics. Used only with your consent (Art. 6 (1) (a) GDPR); IP addresses are truncated. Data may be transferred to Google LLC in the USA (EU-US Data Privacy Framework). Withdraw consent anytime via cookie settings.
Meta Pixel (Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland): measurement of ad performance. Used only with your consent (Art. 6 (1) (a) GDPR). Data may be transferred to Meta Platforms, Inc. in the USA (EU-US Data Privacy Framework).
11. Your rights
You have the right to access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and the right to object at any time, on grounds relating to your particular situation, to processing based on Art. 6 (1) (f) GDPR (Art. 21 GDPR). Where processing is based on consent, you may withdraw it at any time with effect for the future (Art. 7 (3) GDPR). You also have the right to lodge a complaint with a supervisory authority (Art. 77 GDPR), for example the Berliner Beauftragte für Datenschutz und Informationsfreiheit.
12. Obligation to provide data; automated decisions
Providing data marked as required is necessary to conclude and perform the contract; otherwise, providing data is voluntary. We do not use automated decision-making, including profiling, within the meaning of Art. 22 GDPR.
13. Changes
We may update this privacy policy when our services or the legal situation change. The current version is always available on this page.
