Withdrawal Policy (Widerrufsbelehrung)

Consumers have the following right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, take(s) possession of the goods; in the case of a contract for several goods ordered in one order and delivered separately, from the day on which you take possession of the last goods.
To exercise your right of withdrawal, you must inform us (Yulia Kostynska (Julie Poly), Stargarder Straße [Hausnummer], 10437 Berlin, Germany, email: info@temptress.me, phone: +49 176 64821750) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us, without undue delay and no later than fourteen days from the day on which we receive notice of your withdrawal. We will use the same means of payment as you used for the initial transaction, unless expressly agreed otherwise; in no event will you be charged fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.
You shall send back the goods without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal to us. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion and expiry of the right of withdrawal

The right of withdrawal does not apply to contracts for the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts (§ 312g (2) No. 7 BGB; Art. 16 (j) Directive 2011/83/EU). Single issues of Temptress magazine are therefore excluded from the right of withdrawal. The right of withdrawal does apply to other goods such as t-shirts and merchandise.
For digital content not supplied on a tangible medium (e.g. digital issues provided as a download), the right of withdrawal expires if we have begun performance after you expressly consented to performance beginning before the end of the withdrawal period and acknowledged that you thereby lose your right of withdrawal (§ 356 (5) BGB).
