1. Scope; contract partner
1.1 These Terms and Conditions apply to all orders placed via the online shop at temptress.me. Your contract partner is: Yulia Kostynska (Julie Poly), publisher of Temptress magazine, Stargarder Straße [Hausnummer], 10437 Berlin, Germany, email info@temptress.me, phone +49 176 64821750.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).
1.3 The contract language is English.

2. Conclusion of contract
2.1 The presentation of products in the shop does not constitute a legally binding offer, but an invitation to place an order.
2.2 You can place products in the shopping cart and review and correct your entries at any time before submitting the order.By clicking the final order button, which is clearly labelled to indicate an obligation to pay, you submit a binding offer to purchase the products in your cart.
2.3 The contract is concluded when we accept your order by sending an order confirmation email.
2.4 We store the text of the contract. The order data is sent to you by email with the order confirmation; these Terms and Conditions are available on this page at any time.
3. Prices and shipping costs
3.1 All prices are total prices and include statutory VAT.
3.2 Shipping costs are charged in addition and are shown on the Shipping & Payment page and during checkout before you place the order.
3.3 For deliveries outside the EU, additional customs duties, taxes or fees may be payable by you to the local customs or tax authorities; these are not covered by us.
4. Payment
Payment is possible via the payment methods shown in the checkout:Shop pay, PayPal, Apple Pay, Google Pay.

5. Delivery
5.1 We ship worldwide unless stated otherwise for a specific product.
5.2 Delivery times are stated on the Shipping & Payment page and in the checkout. If a delivery time is not stated, delivery takes place within 3-20 working days after conclusion of the contract (for prepayment: after receipt of payment).
6. Right of withdrawal
6.1 Consumers have a statutory right of withdrawal as described in our Withdrawal Policy (Widerrufsbelehrung), which also contains the model withdrawal form.
6.2 The right of withdrawal does not apply to contracts for the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts (§ 312g (2) No. 7
BGB). Single issues of Temptress are therefore excluded from the right of withdrawal.
6.3 For digital content not supplied on a tangible medium (e.g. digital issues), the right of withdrawal expires under the conditions described in the Withdrawal Policy (§ 356 (5) BGB).
7. Retention of title
The goods remain our property until full payment of the purchase price.
8. Warranty
The statutory warranty rights (defect liability) apply. Nothing in these Terms limits the statutory rights of consumers.
9. Liability
9.1 We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz), and within the scope of any guarantee we have expressly given.

9.2 In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment is a prerequisite for the proper performance of the contract and on whose fulfilment the customer may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract.
9.3 Any further liability is excluded.
10. Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of § 36 VSBG.
11. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in another country, mandatory consumer protection provisions of that country remain unaffected by this choice of law.
